Erika Birg will present "Technology and IP Arbitration" and "The Award and Post-Award Issues" at the 2025 Arbitration Institute hosted by the American Bar Association on June 12–13, 2025.
The first presentation will cover several important topics related to technology and intellectual property arbitration. The session will explore case management issues, examine when and how to use tutorials, and consider the role of technical experts. Additionally, it will address patent infringement issues, and the challenges associated with complex technology disputes.
The second presentation will provide a comprehensive guide to preparing and drafting arbitration awards. This session will discuss best practices for writing awards, focusing on the needs and expectations of the parties involved and what arbitrators require from them. The presentation will also cover key considerations for ensuring enforceable awards, the limits of independent research by arbitrators, and the distinctions between orders, partial final awards, and final awards.
Birg chairs the firm's Trade Secret and Employee Mobility Practice Group and focuses her practice on helping business owners, officers, and directors protect their companies' interests before, during, and after litigation, with experience in resolving disputes in arbitration, mediation, and state and federal courts throughout the country as a first-chair trial attorney.
